Terms and Conditions of Service

These Terms and Conditions form a client agreement between you the client (hereby referred as you, your) and Sprout & Me, ABN 67 676 190 281 (also referred to as Kate/Kato Matthews, the physiotherapist, we).

These Terms and Conditions also include the Fee Schedule, which can be found by clicking the learn more button below. You must read the Fee Schedule along with these terms and conditions.

In making a booking with Sprout & Me you are accepting these Terms and Conditions and Fee Schedule.

Physiotherapy Services
These Terms and Conditions relate to services provided by Sprout & Me which include; women's health, continence, breastfeeding support, babywearing, pain management, child development via in person consultations, telehealth, courses, education programs and written and video media (Services).

Bookings
1. All clients with bookings will receive an appointment reminder 24 hours before their appointment time, which must be confirmed via completion of the pre-screening questionnaire, and for Initial Consultations, via acceptance of the Consent to Treatment form delivered via email.
2. In cases where confirmation has not been received, Sprout & Me will reasonably endeavour to contact you to confirm your appointment and obtain pre-appointment documentation.
3. By booking your appointment you are accepting Sprout & Me’s cancellation and ‘no show’ policy and Fee Schedule as outlined in these Terms and Conditions.
4. By booking an appointment, you are accepting subscription to Sprout & Me’s mailing list.
Fee schedule and Payment
1. Please read the Fee Schedule outlined here.
2. You accept the Fee Schedule as it pertains to the relevant packages and Services you have booked.
3. Payment is expected on or before the day of your appointment and bookings may incur a non-refundable deposit of 50%.
4. Payment for services can be made via bank transfer, EFTPOS or cash, we are exploring the use of third-party payment systems such as Stripe, terms and conditions can be found here.
Travel charges
Appointments outside of the Kununurra area may incur a travel fee. Telehealth appointments are also available.
Deposits
1. A non-refundable deposit of 50% may be taken on booking your appointment. The deposit can be made via bank transfer or use of debit or credit card via third party payment systems as outlined above. Under no circumstances will the deposit be refunded if the appointment is cancelled by you.
2. Please see the following Cancellation Policy for procedures should your appointment be rescheduled by you, the client or Sprout & Me.
Cancellation policy - cancellation/late cancellation
1. 24 hours' notice is required to cancel or reschedule your physiotherapy appointment and not incur additional costs beyond the non-refundable deposit.
2. If you cancel your booking before these 24 hours and do not attempt to reschedule your appointment within 48 hours from your original appointment time, 50% of your appointment fee will be charged.
3. If you cancel within 24 hours of your appointment time and do not attempt to reschedule your appointment within 48 hours of your original appointment, 100% of the appointment fee will be charged.
4. New appointment times are subject to availability.
5. If your appointment is cancelled by Sprout & Me within 24 hours of your appointment time, no financial penalty will be incurred by you.
6. If in the event your appointment is cancelled by Sprout & Me and no suitable replacement appointment can be arranged in a reasonable timeframe, your full deposit will be refunded.
No Show Policy
A “No Show” occurs in the event that Sprout & Me or one of their representatives, arrives at the designated appointment address at the appointment time and you are not there within 15 minutes of the appointment commencing.

1. In the event of a ‘no show’ all reasonable attempts will be made by Sprout & Me to contact you and make an alternative appointment.
2. If an alternative appointment is not made within 48 hours of the appointment time, 100% of the appointment fee plus travel costs as outlined in these Terms and Conditions will be invoiced to you and payable within 7 days via direct debit or third party system.
Delivery of Services (egbusiness hours, ongoing support)
Sprout & Me business hours are Monday to Friday, 8:30am to 2pm unless otherwise specified. Correspondence, phone calls and support outside of these hours are at the discretion of the physiotherapist.
Dispute resolution process
Sprout & Me are committed to you as their client and your customer satisfaction. If, in the event you are unhappy with the Services provided by Sprout & Me, we encourage you to contact us at kato@sproutandme.com.au to discuss your complaint and rectify if appropriate.

Limitation of Liability
To the extent permitted by law I, Sprout & Me, Kate/Kato Matthews will not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.
Indemnification
You agree to indemnify, defend and hold harmless Sprout & Me, Kate/Kato Matthews from any claim or demand, including reasonable legal fees, made by any third party due to, or arising out of, your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Private Health funds
If you have private health insurance, you are responsible for liaising directly with your private health fund to determine if you are eligible for private health benefits in respect of the services you receive from Sprout & Me, Kate/Kato Matthews.
Kangatraining Classes

Kangatraining Kununurra is committed to supporting you maintain your physical, mental, emotional and social health wherever, so we are still offering hybrid classesl! This means you can attend either in-person or via zoom.
Our schedule of classes will be announced as soon as possible for each term. Extra "pop-up" classes may be arranged with short notice. Class schedules will be updated on our social media and website Kangatraining Kununurra (sproutandme.com.au).

Classes operate in Western Australian Standard Times. Please arrive or login 15 minutes prior to class commencement. Please expect and be patient with any teething issues, while we manage the hybrid format. Thank you!
Babies and children
All Kangas are responsible for keeping their child/children safe at all times during hybrid Kangatraining classes. If, during the session, your child/children become unsettled or need to be changed, or if you feel that you need to take time out for whatever reason, please do so.
Older children are more than welcome at Kangatraining classes; please ensure that they do not become a trip hazard for you or others. We may need to revise this pending any further COVD-19 restrictions imposed.

All virtual participants will be kept on mute for the class so any noise at their end won’t be a distraction for others. Please unmute to speak with your Kangatraining instructor or other participants.
Participants
Kangatraining is unfortunately not suitable while you are pregnant; please advise your instructor should you become pregnant during term. You and your new joey will be welcomed back to Kangatraining classes with open arms when you return after the birth!

Kangatraining is otherwise safe and beneficial for anyone, and for this reason we also welcome dads, grandparents, aunties, uncles, friends, non-birth parents… Anyone who can safely wear a baby! And even then, wearing a baby is not essential. Please join in regardless of whether you will be wearing a baby. All that is required is a completed health questionnaire and waiver for all participants.

Your Kangatraining Instructor will be in touch to meet with you via Zoom prior to your first virtual class. This will involve a 15-minute discussion to review your health questionnaire, answer any of your questions and facilitate a carrier fitting. This is to provide optimal support for you and your child’s safety during virtual classes.

Please note that numbers of participants for classes may be capped so that we can still maintain the quality of service, as well as the fun, family, and fitness that you expect from Kangatraining Kununurra.

Cancellation and make up classes
As a Mum myself, I understand that ‘life’ can sometimes get in the way of your plans, especially given the unusual circumstances we find ourselves in! If you are unwell or injured please do not attend a session, rest and recover and we will see you when you are better. Where possible, please provide at least two (2) hours’ notice if you are unable to make it to your scheduled class.

There will be a maximum of one (1) make up class per term, which may be taken up on an alternative day or during the extra week/s of classes added at the end of term for this purpose.
​
Make ups can only be taken within the duration of the relevant term and will only be granted where a minimum of two (2) hours’ notice is given. Class passes are not transferable, and no refunds will be given in any circumstances, excepting if you become pregnant during the term period.

Please respect the venues’ rules and belongings and leave everything in a tidy manner. Please take all dirty nappies with you for your own disposal. Neither the venue nor I take responsibility for the loss or damage of your property, so please refrain from bringing valuables with you, including leaving such items in your car.

Zoom and vimeo links, passwords, and access are all limited to registered and paid clients only. These are not to be shared to anyone, whether they are a registered Kangatraining Kununurra participant or not. Sessions are subject to copyright.
Disclaimer
You should understand that when participating in any exercise or dance program, there is the possibility of physical injury. If you engage in any of our online or virtual choreographed routines, you agree that you do so at your own risk, are voluntarily participating in these activities, assume all risk of injury to yourself, and agree to release and discharge Kangatraining Kununurra for any and all claims or causes of action, known or unknown, arising out of Kangatraining Kununurra negligence. If wearing your baby, it is solely your responsibility to ensure the carrier is optimal, correctly fitted and safe for the activity you are partaking in.
